В настоящем документе (далее «Документ»), изложены условия обмена персональной информацией и конфиденциальности между https://portdazur.com  (далее «Веб-сайт») и пользователем Веб-сайта (субъектом).

Собственником персональных данных, товарного знака «Port d’Azur» и доменного имени portdazur.com (далее «Собственник») является юридическое лицо Азербайджанской Республики, ООО «SB DEVELOPMENT»

Настоящим, собственник заявляет, что сбор персональной информации субъекта такой как имя, фамилия, отчество, номер телефона или адрес электронной почты осуществляется с целью ознакомления потенциального клиента с торговыми предложениями и будет использоваться собственником или оператором для указанных целей.

Размещение персональных данных субъектом на сайте основывается на принципе добровольности, и охраняются собственником и оператором с момента их предоставления. Размещая персональную информацию на сайте, субъект дает согласие на сбор, обработку и хранение такой информации собственником или оператором. Предоставленная субъектом персональная информация (имя, фамилия, отчество, номер телефона и адрес электронной почты) защищены собственником в соответствии со статьей 5 Закона Азербайджанской Республики «О персональных данных». За исключением случаев, предусмотренных статьей 13 Закона Азербайджанской Республики «О персональных данных» конфиденциальная персональная информация может быть предоставлена третьим лицам только с согласия субъекта.

В отношении ресурса персональных данных принадлежащего собственнику Субъект имеет право:  

— получать от собственника или оператора информацию о наличии персональных данных о нем;

— требовать правового обоснования сбора, обработки и передачи третьим лицам имеющихся персональных данных о нем, получать информацию о том, к каким правовым последствиям для субъекта может привести сбор, обработка и передача третьим лицам этих данных;

— знакомиться с содержанием персональных данных, накопленных о нем в ресурсе персональных данных;

— знать цель сбора и обработки персональных данных о нем, сроки, способы их обработки, круг лиц, имеющих разрешение на ознакомление с его персональными данными, в том числе информационных систем, предусматривающих осуществление информационного обмена;

— требовать изменения и за исключением установленных законодательством случаев, уничтожения любых собранных персональных данных о нем, а также подавать обращение о передаче этих данных в установленном порядке в архив; требовать наложения запрета на сбор и обработку персональных данных о нем;

— получать информацию об источниках получения любых собранных персональных данных о нем, требовать доказательства законности этих данных;

— требовать защиты любых собранных персональных данных о нем;

— пользоваться другими правами, установленными Законом и иными нормативноправовыми актами Азербайджанской Республики.

Персональные данные субъекта собранные собственником хранятся в ресурсе персональных данных, созданном собственником. Значение основных понятий используемых в настоящем Документе соответствуют значениям, данным в Законе Азербайджанской Республики «О персональных данных».

Субъект, размещающий персональную информацию в соответствующем порядке на Вебсайте, тем самым выражает согласие с условиями настоящего Документа.

This document (hereinafter referred to as the "Document") sets out the conditions for the exchange of personal information and confidentiality between https://portdazur.com  (hereinafter referred to as the "Website") and the user of the Website (subject).

The owner of personal data, the trademark "Port d’Azur" and the domain name portdazur.com  (hereinafter referred to as the "Owner") is a legal entity of the Republic of Azerbaijan, LLC “SB DEVELOPMENT”.

Hereby, the owner declares that the collection of personal information of the subject such as name, surname, patronymic, phone number or e-mail address is carried out in order to familiarize the potential client with trade offers and will be used by the owner or operator for these purposes.

The placement of personal data by the subject on the site is based on the principle of voluntariness, and is protected by the owner and operator from the moment they are provided. By posting personal information on the site, the subject agrees to the collection, processing and storage of such information by the owner or operator. The personal information provided by the subject (name, surname, patronymic, telephone number and e-mail address) are protected by the owner in accordance with Article 5 of the Law of the Republic of Azerbaijan "On Personal Data". With the exception of cases provided for in Article 13 of the Law of the Republic of Azerbaijan "On Personal Data", confidential personal information may be provided to third parties only with the consent of the subject.

With regard to the personal data resource owned by the owner, the Subject has the right to:  

— receive from the owner or operator information about the availability of personal data about him;

— require a legal justification for the collection, processing and transfer to third parties of the available personal data about him, to receive information about what legal consequences for the subject may lead to the collection, processing and transfer of this data to third parties;

— get acquainted with the content of personal data accumulated about him in the personal data resource;

— know the purpose of collecting and processing personal data about him, the terms, methods of their processing, the circle of persons who have permission to get acquainted with his personal data, including information systems that provide for the implementation of information exchange;

— demand the change and, with the exception of cases established by law, the destruction of any personal data collected about him, as well as submit an application for the transfer of this data in the prescribed manner to the archive; demand a ban on the collection and processing of personal data about him; receive information about the sources of any personal data collected about him, require proof of the legality of these data;

— demand the protection of any personal data collected about him;

— other rights established by the Law and other normative legal acts of the Azerbaijan Republic.

The subject's personal data collected by the owner is stored in the personal data resource created by the owner. The meaning of the main concepts used in this Document correspond to the meanings given in the Law of the Republic of Azerbaijan "On Personal Data". The subject, placing personal information in the appropriate order on the Website, thereby agrees to the terms of this T&C.

Bu sənəd (bundan sonra “Sənəd”) https://portdazur.com  (bundan sonra “Veb-sayt”) ilə Veb-saytın istifadəçisi (mövzu) arasında şəxsi məlumatların mübadiləsi və məxfiliyin təmin edilməsi şərtlərini müəyyən edir.

Fərdi məlumatların, "Port d’Azur" ticarət nişanının və portdazur.com  domen adının (bundan sonra “Sahibi” adlandırılacaq) sahibi Azərbaycan Respublikasının hüquqi şəxsi “SB DEVELOPMENT” MMC-dir.

Bununla, mülkiyyətçi bəyan edir ki, subyektin ad, soyad, ata adı, telefon nömrəsi və ya e-poçt ünvanı kimi şəxsi məlumatlarının toplanması potensial müştərini ticarət təklifləri ilə tanış etmək məqsədilə həyata keçirilir və sahibi və ya bu məqsədlər üçün operator. Fərdi məlumatların subyekt tərəfindən saytda yerləşdirilməsi könüllülük prinsipinə əsaslanır və təqdim edildiyi andan sahibi və operator tərəfindən qorunur. Saytda şəxsi məlumatları yerləşdirməklə subyekt bu cür məlumatların sahibi və ya operator tərəfindən toplanması, işlənməsi və saxlanmasına razılıq verir. Subyekt tərəfindən təqdim edilən fərdi məlumatlar (ad, soyad, ata adı, telefon nömrəsi və elektron poçt ünvanı) “Fərdi məlumatlar haqqında” Azərbaycan Respublikası Qanununun 5-ci maddəsinə uyğun olaraq sahibi tərəfindən mühafizə olunur. “Fərdi məlumatlar haqqında” Azərbaycan Respublikası Qanununun 13-cü maddəsində nəzərdə tutulmuş hallar istisna olmaqla, məxfi şəxsi məlumatlar yalnız subyektin razılığı ilə üçüncü şəxslərə verilə bilər.

Sahibinə məxsus fərdi məlumat resursuna gəldikdə, Subyekt aşağıdakı hüquqlara malikdir:  

— sahibindən və ya operatordan onun haqqında şəxsi məlumatların mövcudluğu haqqında məlumat almaq;

— barəsində mövcud olan fərdi məlumatların toplanması, işlənməsi və üçüncü şəxslərə ötürülməsi üçün hüquqi əsaslandırma tələb etmək, bu məlumatların toplanması, emalı və üçüncü şəxslərə verilməsinin subyekt üçün hansı hüquqi nəticələrinin ola biləcəyi barədə məlumat almaq;

— şəxsi məlumat resursunda onun haqqında toplanmış fərdi məlumatların məzmunu ilə tanış olmaq;

— onun haqqında fərdi məlumatların toplanması və emalının məqsədini, onların emalı şərtlərini, üsullarını, onun şəxsi məlumatları ilə, o cümlədən məlumat mübadiləsinin həyata keçirilməsini təmin edən informasiya sistemləri ilə tanış olmağa icazəsi olan şəxslərin dairəsini bilməli;

— qanunla müəyyən edilmiş hallar istisna olmaqla, barəsində toplanmış hər hansı fərdi məlumatın dəyişdirilməsini və məhv edilməsini tələb etmək, habelə bu məlumatların müəyyən edilmiş qaydada arxivə verilməsi üçün ərizə vermək;

— onun haqqında şəxsi məlumatların toplanmasına və emalına qadağa qoyulmasını tələb etmək;

— onun haqqında toplanmış hər hansı fərdi məlumatların mənbələri haqqında məlumat almaq, bu məlumatların qanuniliyinin sübutunu tələb etmək;

— onun haqqında toplanmış hər hansı şəxsi məlumatların qorunmasını tələb etmək;

— Azərbaycan Respublikasının Qanunu və digər normativ hüquqi aktları ilə müəyyən edilmiş digər hüquqlardan istifadə etmək.

Sahib tərəfindən toplanan subyektin şəxsi məlumatları sahibin yaratdığı fərdi məlumat resursunda saxlanılır.

Bu Sənəddə istifadə olunan əsas anlayışların mənası “Fərdi məlumatlar haqqında” Azərbaycan Respublikasının Qanununda verilmiş mənalara uyğundur. Şəxsi məlumatları Vebsaytda müvafiq qaydada yerləşdirən subyekt bununla da bu Şərtlər və Müqavilənin şərtləri ilə razılaşır.
